Subject:           Enactment of Public Law 114-328, National Defense Authorization Act for Fiscal Year 2017

This Information Bulletin (IB) is to alert all affected BLM personnel to the enactment of Public Law 114-328, the National Defense Authorization Act for Fiscal Year 2017.  The new law contains the following seven provisions of interest to the BLM:

  1. Land Management Workforce Flexibility Act – Sec. 1135, Eligibility of employees in a time-limited appointment to compete for a permanent appointment at any Federal agency;
  2. Campion Air Force Radar Station (AK) – Sec. 2822, Land conveyance, Campion Air Force Radar Station, Galena, Alaska;
  3. St. George National Guard Armory (UT) – Sec. 2829, Land conveyance, St. George National Guard Armory, St. George, Utah;
  4. Fort Wingate (NM) – Sec. 2829F, Return of certain lands at Fort Wingate, New Mexico, to the original inhabitants;
  5. Naval Air Weapons Station China Lake (CA) – Sec. 2845, Duration of withdrawal and reservation of public land, Naval Air Weapons Station China Lake, California;
  6. Utah Test and Training Range (UT) – Title XXX, Utah Test and Training Range and Related Matters; and
  7. Pribilof Islands (AK) – Title XXXV, Subtitle B, Pribilof Islands Transition Completion.

The text of the new law and the legislative maps it references are attached.  The legislative maps referenced in the new law should be made available to the public, as appropriate, and archived by the BLM Eastern States Office and the Department of the Interior Library pursuant to Permanent Instruction Memorandum (IM) No. 2017-007, “Policies and Procedures for Notification and Implementation of Newly Enacted Federal Laws.”

Also pursuant to Permanent IM No. 2017-007, the BLM Assistant, State and Center Director(s) receiving this IB are responsible for:

  1. Ensuring that the appropriate staff in their organizations receive a copy of the IB and any attachments;
  2. Submitting to the BLM Director and the Assistant Director for Communications within 60 days an Implementation Plan that details the steps that will be taken to implement the new law, the timeframes for completing implementation, and any barriers to implementation.  In this case, the lead for the Implementation Plan for each section is as follows:
    1. Section 1135: Assistant Director, Human Capital Management
    2. Section 2822 (Campion Radar Station) and Title XXXV, Subtitle B (Pribilof Islands): BLM-Alaska
    3. Section 2829 (St. George Armory) and Title XXX (UTTR): BLM-Utah
    4. Section 2845 (China Lake): BLM-California
    5. Section 2829F (Ft. Wingate): BLM-New Mexico
  3. Developing any necessary policy guidance to ensure compliance with the new law;
  4. Carrying out any implementation actions required under the new law; and
  5. Complying with any other applicable BLM policies, including Manual 6120, “Congressionally Required Maps and Legal Boundary Descriptions for National Landscape Conservation System Designations.”
