Subject:           Enactment of Public Law 115-232, National Defense Authorization Act for Fiscal Year 2019

This Information Bulletin is to alert all affected BLM personnel to the enactment of Public Law 115-232 (enrolled bill H.R. 5515) the National Defense Authorization Act for Fiscal Year 2019.  The new law contains the following three provisions of interest to the BLM:

  1. Fort Knox (KY) – Sec. 320 – production and use of natural gas at Fort Knox, Kentucky;
  2. Twentynine Palms (CA) and Yuma (AZ) – Sec. 2842 -- transfer of administrative jurisdiction over certain lands, Marine Corps Air Ground Combat Center Twentynine Palms, California, and Marine Corps Air Station Yuma, Arizona; and
  3. Limestone Hills (MT) – Sec. 2850 -- technical correction of description of Limestone Hills Training Area Land Withdrawal and Reservation, Montana.

The text of the new law (enrolled bill H.R. 5515) and the legislative map it references are attached.  The legislative map referenced in the new law should be made available to the public, as appropriate, and archived by the BLM Eastern States Office and the Department of the Interior Library pursuant to Permanent Instruction Memorandum (IM) No. 2017-007, “Policies and Procedures for Notification and Implementation of Newly Enacted Laws.”

Also pursuant to Permanent IM No. 2017-007, the BLM Assistant, State, and Center Director(s) receiving this IB are responsible for:

  1. Ensuring that the appropriate staff in their organizations receive a copy of the IB and any attachments;
  2. Submitting to the BLM Director within 60 days an Implementation Plan that details the steps that will be taken to implement the new law, the timeframes for completing implementation, and any barriers to implementation.  A copy of the Implementation Plan should also be sent to the Assistant Director for Communications.  The lead for the Implementation Plan for each section is as follows:
    1. Section 320: BLM-Eastern States Office
    2. Section 2842: BLM-Arizona and BLM-California
    3. Section 2850: BLM-Montana.
  3. Developing any necessary policy guidance to ensure compliance with the new law;
  4. Carrying out any implementation actions required under the new law; and
  5. Complying with any other applicable BLM policies.
