Subject: Expired Instruction Memorandum 2008-175, “Consultation Process on Proposed Improvements to Revised Statute (R.S.) 2477 Rights-of-Way”
On August 8, 2008, the BLM issued Instruction Memorandum (IM) 2008-175, “Consultation Process on Proposed Improvements to Revised Statute (R.S.) 2477 Rights-of-Way.” IM 2008-175 expired on September 30, 2009, and is no longer effective, and the BLM will no longer cite or use it for support in consultations between the BLM and an R.S. 2477 right-of-way (ROW) holder relating to proposed improvements of an R.S. 2477 ROW. The BLM Headquarters intends to issue new guidance covering this consultation process consistent with applicable caselaw. If BLM staff are approached by an R.S. 2477 ROW holder regarding a proposed improvement of an R.S. 2477 ROW before issuance of new guidance, please notify my staff at the contact information below so that we may effectively coordinate with the Office of the Solicitor.
