Southeastern States District NEPA
Proposed project development on BLM public lands requires analysis under the Federal Land Policy and Management Act (FLPMA) and the National Environmental Policy Act (NEPA). FLPMA requires that the BLM develops and maintains Resource Management Plans (RMPs) for its managed public surface and mineral estate. Regulations under FLPMA also state that proposed on-the-ground actions must be consistent with an RMP’s decisions. NEPA ensures that the BLM (and other Federal agencies) consider the impact of a proposed action on the quality of the human environment before a decision is made to proceed.
Two types of NEPA documents, the Environmental Assessment (EA) and the Environmental Impact Statement (EIS), are required to involve some level of public involvement if not formal comment periods. Proposed federal actions or projects can be found in the NEPA Project Log.

The Federal Energy Regulatory Commission (Commission or FERC) has prepared a draft environmental impact statement (EIS) for the projects proposed by Mountain Valley Pipeline LLC (Mountain Valley) The BLM, COE, and FS may adopt and use the EIS when they consider the issuance of a Right-of-Way Grant to Mountain Valley for the portion of the MVP that would cross federal lands, Comments on the draft EIS must be received by FERC in Washington, DC on or before December 22, 2016.Once the final EIS is issued, the FERC Commissioners will take into consideration staff’s recommendations when they make a decision on the Project.
