Unauthorized Use

Issuance of a notice of trespass or other enforcement actions will occur if an unpatented mining claim, tunnel site, mill site or land open or closed to mineral entry is:

• Used for a home site, place of business, or for other purposes not reasonably incident to locatable mineral mining or milling activities

• Used for the mining and sale of leasable minerals or common variety mineral materials, such as sand, gravel and stone or

• Operations are conducted on land that is withdrawn from mineral entry absent a pre-existing claim.

Trespass notices or other enforcement actions are taken by the Field Office.
