Notice of Availability of the Record of Decision for the Coeur d’Alene Resource Management Plan RMP)/Environmental Impact Statement (EIS)  

AGENCY : Bureau of Land Management (BLM), Department of the Interior.

ACTION : Notice of Availability of Record of Decision (ROD).

SUMMARY : In accordance with the National Environmental Policy Act (NEPA), the Federal Land Policy and Management Act (FLPMA), and BLM Policy, the BLM announces the availability of the RMP/ROD for the Coeur d’Alene Field Office located in Idaho. The Idaho State Director signed the ROD on June 29, 2007, and it is effective as of that date.

SUPPLEMENTARY INFORMATION : The Coeur d’Alene RMP was developed with broad public participation through a three year collaborative planning process. This RMP addresses management on approximately 97,900 acres of public land in the planning area. The Coeur d’Alene RMP is designed to achieve or maintain desired future conditions developed through the planning process. It includes a series of management actions to meet the desired resource conditions for forest, upland, and riparian vegetation; wildlife habitats; cultural and visual resources; and recreation. The approved Coeur d’Alene RMP is essentially the same as Alternative D in the Proposed RMP/ Final Environmental Impact Statement (PRMP/FEIS), published in October 2006.

The BLM received two protests to the PRMP/FEIS which the Director of BLM resolved without requiring significant changes to proposed decisions in the PRMP/FEIS. No inconsistencies with State or local plans, policies, or programs were identified during the Governor’s consistency review of the PRMP/FEIS. Thus, as a result of the lack of substantive comments in the protest and consistency review stages, only minor editorial modifications were made in preparing the ROD/RMP. These modifications corrected errors that were noted during review of the PRMP/FEIS and provide further clarification for some of the decisions.

The RMP includes decisions identifying designated routes of travel for motorized vehicles, which are implementation level decisions and are therefore appealable under 43 CFR Part 4. These decisions (route identifications) are displayed on travel management maps in the ROD/RMP. Any party adversely affected by these route identifications may appeal within 30 days of publication of this Notice of Availability, pursuant to 43 CFR part 4, subpart E. The appeal should identify the specific route(s) by township, range, and section on which the decision is being appealed. Please consult the appropriate regulations (43 CFR part 4, subpart E) for further appeal requirements. The appeal must be filed with the Field Manager of the Coeur d’Alene Field Office at the above listed address. Before including your address, phone number, e-mail address, or other personal identifying information in your appeal, you should be aware that your entire appeal—including your personal identifying information—may be made publicly available at any time. While you can ask us in your appeal to withhold your personal identifying information from public review, we cannot guarantee that we will be able to do so.

SUMMARY: In accordance with the National Environmental Policy Act of 1969 and the Federal Land Policy and Management Act of 1976, the Bureau of Land Management (BLM) has prepared a Draft Resource Management Plan/ Environmental Impact Statement (RMP/EIS) for the Coeur d ' Alene Field Office.

DATES: To assure that they will be considered, BLM must receive written comments on the Draft RMP/EIS within 90 days following the date the Environmental Protection Agency publishes the Notice of Availability in the Federal Register. The BLM will announce future meetings or hearings and any other public involvement activities through public notices, news media released, and/or mailings, and on the BLM Web site ( http://www.blm.gov/rmp/id/cda/ ).

The planning area covers approximately 96,770 acres of public lands within the following Idaho Counties: Benewah, Bonner, Boundary, Kootenai, and Shoshone. The RMP will provide future broad-scale management direction for use and protection of resources managed by the Coeur d ' Alene Field Office. The Draft RMP/EIS was developed through a collaborative planning process and considers four alternatives. The primary issues addressed include: recreational travel management, management of forest products and protection of other resources, adjustments to Federal land ownership, invasive plants, protection of property from wildfire, and protection and restoration of watersheds and riparian areas.

The preferred alternative proposes designation of five areas of critical environmental concern (ACECs), four of which would become Research Natural Areas (RNAs): Hideaway Islands RNA--76 acres (existing); Lund Creek RNA--3,206 acres (2,905 acres existing); Farnham Forest RNA--33 acres; Windy Bay RNA--16 acres; and Pulaski Tunnel ACEC--27 acres. The preferred alternative specifies a no surface occupancy stipulation on future mineral leases within all ACECs/RNAs. Additionally, BLM would recommend Pulaski Tunnel ACEC for withdrawal from the mining laws. All of the RNAs would be designated as right-of- way exclusion areas and would have restrictions for vegetation treatments and timber harvests. The Farnham Forest RNA would be closed to motorized vehicles. Motorized use in all other areas would be limited to designated roads and trails.

Sixteen other ACECs were considered under other alternatives, but were not included in the preferred alternative: Constitution Mine and Millsite ACEC--6 acres; Gamlin Lake ACEC--59 acres; Hecla-Star Tailings Piles ACEC--22 acres; Killarney Lake ACEC--69 acres; Kootenai River Front ACEC--533 acres; Liberal King Millsite ACEC--2 acres; Little North Fork Clearwater River ACEC--9,592 acres; Morton Slough ACEC--119 acres; Mother Load Mine ACEC--0.8 acres; Nabob Millsite

ACEC--8 acres; Rex Millsite Tailings Pile ACEC--6 acres; Rochat Divide ACEC--11,653 acres; Sidney Mine and Millsite ACEC--6 acres; Wallace Landfill ACEC--0.3 acres; We-Like Mine ACEC--0.3 acres; Wolf Lodge Bay ACEC--1,094 acres. Restrictions on use of public lands within these areas would vary, depending on the alternative and the values identified for protection, but would include limitations on mining, off-highway vehicle use, and vegetation treatments.

The preferred alternative also recommends four suitable segments of river for inclusion in the National Wild and Scenic River system: Little North Fork Clearwater River--2.5 miles wild classification and 1.1 miles recreation classification; Lost Lake Creek--3.0 miles wild classification and 0.3 miles scenic classification; Little Lost Lake Creek--3.0 miles wild classification; and Lund Creek--3.9 miles wild classification. A segment of the Kootenai River (14 miles) was found eligible, but under the preferred alternative, suitability determination would be deferred until the Idaho Panhandle National Forest (the primary land owner along this segment) makes a suitability determination on adjacent segments.

Notice of Intent To Prepare a Resource Management Plan and Associated Environmental Impact Statement for the Coeur d'Alene Field Office

SUMMARY: This document provides notice that the Bureau of Land Management (BLM) intends to prepare an RMP with an associated EIS for the Coeur d'Alene Field Office. The planning area for the RMP, which includes 96,745 acres of BLM-administered public land, is located in Boundary, Bonner, Kootenai, Benewah, and Shoshone Counties, Idaho. Preparation of this RMP and EIS will conform with the Federal Land Policy and Management Act (FLPMA), the National Environmental Policy Act (NEPA), Federal Regulations, and BLM management policies.

DATES: This notice initiates the public scoping process. Comments on the scope of the plan, including issues or concerns that should be considered, should be submitted in writing to the address listed below by November 15, 2004. However, collaboration with the public will continue throughout the planning process. Dates and locations for public meetings will be announced through local news media, newsletters, and the BLM Web site (http://www.id.blm.gov/planning/cdarmp/index.htm), at least 15 days prior to the event.

SUPPLEMENTARY INFORMATION: The Coeur d'Alene RMP planning area is located entirely in the northern part of the Idaho panhandle. The area is bordered to the west by the Washington state line, to the north by the Canadian border, to the east by the Montana state line, and to the south by Latah and Clearwater Counties, Idaho. The Coeur d'Alene Field Office planning area also lies partially within the ceded territory of the Coeur d'Alene Tribe. The Coeur d'Alene Reservation lies entirely within the planning area, and there are about 180 acres of BLM- administered land within the reservation boundary. Management of BLM- administered lands within the ceded area and the reservation boundaries will involve trust and treaty resources. Other Federally recognized tribes with aboriginal or historic ties to the planning area include the Kootenai Tribe in Idaho, the Kalispell Tribe in Washington, and the Salish and Kootenai Tribes in Montana.

The BLM-administered public lands within the Coeur d'Alene Field Office planning area are currently managed in accordance with the decisions in the 1981 Emerald Empire Management Framework Plan (MFP) as amended. BLM will continue to manage these lands in accordance with the MFP and amendments until the RMP is completed and a Record of Decision is signed.

Preparation of an RMP for the Coeur d'Alene Field Office is necessary to respond to changing resource conditions; respond to new issues; and prepare a comprehensive framework for managing public lands administered by the field office. The RMP will establish new land use planning decisions to address issues identified through public scoping and, where appropriate, will incorporate decisions from the existing Emerald Empire MFP.

Public Participation: The BLM will work collaboratively with interested parties to identify the management decisions that are best suited to local, regional, and national interests. The public scoping process will help identify planning issues and provide for public comment on the proposed planning criteria.

BLM has identified the following preliminary issue themes:
1. Vegetation management (including noxious weeds, riparian areas and wetlands, and fuels and forest management).

2. Fire management.

3. Management of habitat for wildlife and special status species.

4. Management of transportation, public access, and recreational opportunities.

5. Land tenure adjustments.

6. Availability and management of public lands for commercial uses (minerals, forest products and livestock grazing).

7. Management of areas with special values.

8. Tribal treaty rights and trust responsibilities.

These preliminary issue themes are not final and may be refined or added to through future public participation.

BLM has also identified some preliminary planning criteria to guide development of the plan, to avoid unnecessary data collection and analysis, and to ensure the plan is tailored to the issues.

These criteria may be modified or other criteria identified during the public scoping process. The public is invited to comment on the following preliminary planning criteria:
1. The plan will comply with all applicable laws, regulations, and current policies. This includes local, State, tribal, and Federal air quality standards; as well as water quality standards from the Idaho Non-Point Source Management Program Plans.

2. The RMP planning effort will be collaborative and multi- jurisdictional in nature. The BLM will strive to ensure that its management decisions are complementary to other planning jurisdictions and adjoining properties, within the boundaries described by law and Federal Regulations.

3. All previously established Wilderness Study Areas will continue to be managed for wilderness values and character until Congress designates them as wilderness areas, or releases them for multiple use management.

4. The RMP will recognize all valid existing rights.

5. As part of this RMP process, BLM will analyze areas for potential designation as Areas of Critical Environmental Concern (ACEC) in accordance with 43 CFR 1610.7-2, and river corridors for suitability for designation under the Wild and Scenic Rivers Act.
