Re: APD's in Lea and Eddy Counties, NM

This document is the findings of fact and conclusions of law resulting from an evidentiary hearing ordered by the Interior Board of Land Appeals. See Yates Petroleum Corp. et al., 131 IBLA 230 (1994).

The issue is the competing rights of oil and gas lessees and potash lessees when the leases cover the same ground in the State of New Mexico.

The product of this fact finding hearing is an Order issued by Office of Hearings and Appeals Administrative Law Judge Patricia McDonald on July 7, 2003. The Order upheld the denial of one permit, and remanded all others back to BLM for further consideration. The Order has been appealed back to the IBLA by the Appellants, the Intervenor Potash companies, and by BLM.
