Las Cruces District Office NEPA

Proposed project development on BLM public lands requires analysis under the Federal Land Policy and Management Act (FLPMA) and the National Environmental Policy Act (NEPA). FLPMA requires that the BLM develops and maintains Resource Management Plans (RMPs) for its managed public surface and mineral estate. Regulations under FLPMA also state that proposed on-the-ground actions must be consistent with an RMP’s decisions. NEPA ensures that the BLM (and other Federal agencies) consider the impact of a proposed action on the quality of the human environment before a decision is made to proceed.

Two types of NEPA documents, the Environmental Assessment (EA) and the Environmental Impact Statement (EIS), are required to involve some level of public involvement if not formal comment periods. Oil and Gas Leasing


Leasing of the Federal minerals in Sierra, Otero, and Doña Ana Counties are and will be deferred until a Record of Decision (ROD) for the TriCounty Resource Management Plan (RMP) is signed.  The Federal Register Notice of Intent published December 19, 2013, initiated a deferment of all fluid mineral lease sales in the entire planning area until a ROD for the TriCounty RMP/Environmental Impact Statement (EIS) is obtained.  The deferment of all fluid mineral leasing preserves the BLM’s ability to select a No Leasing alternative which will be incorporated as an alternative in the RMP/EIS.
