The Bureau of Land Management today withdrew its 1991 proposed rule that sought to amend the Federal coal management program. The BLM expects to publish a new proposed rule on coal management later this year.
The BLM has withdrawn its original coal management proposal in response to concerns that comments on the 1991 proposal are no longer applicable because of changes in the coal industry and enactment of other laws and regulations since that time. Prior to developing a new proposal, the BLM will consider information from all interested parties through an Advance Notice of Proposed Rulemaking.
The BLM formally withdrew its proposed coal management rule by means of a notice in today's Federal Register. The Bureau had published its original proposed rule on July 12, 1991, and initially gave the public until September 12, 1991, to comment on its proposal. At the request of those interested in commenting, the BLM extended the comment period for 30 days, setting a new closing date of October 12, 1991.
The BLM also announced today that it will soon publish a final rule on Logical Mining Units or LMUs. The final rule will address issues raised by a 1994 General Accounting Office (GAO) report, titled Mineral Resources: Federal Coal-Leasing Program Nee ds Strengthening, which identified shortcomings in the Federal coal-leasing program.
