Purpose: This IM is to request review of draft migratory bird guidance for the Montana/Dakotas Bureau of Land Management (BLM).
Policy/Action: The attached draft guidance (Attachment 1) would provide migratory bird conservation policy for the Montana/Dakotas BLM organization as outlined in the Memorandum of Understanding (MOU) between the U.S. Fish and Wildlife Service and the BLM, signed on April 12, 2010. This policy will identify strategies to promote conservation and to avoid or minimize adverse impacts on migratory birds. This IM cancels IM MT-2011-039 Review of Draft Migratory Bird Guidance Instruction Memorandum and will be used as interim guidance until final guidance is issued.
Timeframe: Responses are due by close of business April 13, 2012.
Budget Impact: The budget impact is minimal.
Background: The Migratory Bird Treaty Act (MBTA) of 1918, prohibits the take, capture, or killing of any migratory birds, and any parts, nest, or eggs of any such bird (16 U.S.C. 703 (a)). In addition, Executive Order 13186 (January 2001) requires the BLM to ensure MBTA compliance, evaluate the BLM actions and agency plans on migratory birds, initiate actions to minimize the take of migratory birds, and contribute to the conservation of migratory birds.
