Subject: Energy Policy Act Section 390 Categorical Exclusions
 
Program Area: Oil, gas and energy related rights-of-way
 
Purpose: This Information Bulletin (IB) forwards Washington Office (WO) IB No. 2007-073 dated April 25, 2007, and a brochure on the use of Section 390 Categorical Exclusions (CX).
 
Policy/Action: The brochure provides an excellent overview of how the Section 390 Categorical exclusions apply to oil and gas operations on public lands. This brochure reiterates the guidance that has been previously provided to you in WO IM No. 2005-247.
 
It is important to reemphasize the fact that compliance with other environmental laws, regulations, environmental best management practices, wildlife mitigation and coordination with affected state game and fish agencies will still take place.
 
Please share copies of this brochure with any interested parties as opportunities arise.
 
Timeframe: Effective upon issuance.
 
Budget Impact: None.
 
Manual/Handbook Sections Affected: None.
 
Coordination: The attached IB was coordinated with the Assistant Directors for WO-200 and WO-300.
