Temporary Closure Information

Based on the results of the United States Environmental Protection Agency (US EPA) Clear Creek Management Area (CCMA) Asbestos Exposure and Human Health Risk Assessment, the Bureau of Land Management Central Coast Field Office issued a Temporary Closure effective May 1, 2008, to all forms of entry and public use for approximately 31,000 acres of public lands in the CCMA to protect public health and safety.

 Why is the temporary closure necessary?

The temporary closure is necessary for public/employee health and safety reasons.  Long-term management of CCMA was addressed through the RMP developed.


Under what authority did BLM issue the temporary closure?

The closure is authorized under 43 CFR 8364.1 which states:  “To protect persons, property, and public lands and resources, the authorized officer may issue an order to close or restrict use or designated public lands.”  Under the rules, BLM must publish a Federal Register Notice, post the closure notice near area affected, specify persons who are exempt, and cites standard public land order violation penalties that can be imposed by a Federal Magistrate (fine not to exceed $1,000 and/or imprisonment not to exceed 12 months).
