Acquisition of Mining Claims Held Under Maintenance Fee Waiver
10 or More Claims
Please be advised that if a miner owns more than 10 mining claims nationwide, they are not eligible to use a Maintenance Fee Waiver and must pay maintenance fees for the upcoming assessment year. Also, any miner whose acquisition causes them to own more than 10 mining claims must pay maintenance fees for all of their claims for the assessment year in which the claims are acquired, in addition to maintenance fees for the upcoming assessment year, by the following September 1.
For example, if a miner holds 10 claims and has used the Maintenance Fee Waiver in lieu of payment for the current assessment year, and that claimant buys or stakes one or more claims, maintenance fees must be paid for all of their claims for the current assessment year. This payment fulfills the legal requirement for a miner owning more than 10 claims for the current assessment year.
Buying a Claim Which is Under a Waiver:
If a miner acquires a mining claim which is under a waiver, the legal requirements must be fulfilled by the new claim owner. If the new claim owner owns 10 or fewer claims nationwide, an Affidavitof Annual Labor may be used to fulfill the legal requirements for the year in which the claim is acquired. However, if the claimant owns more than 10 claims at any time during the current assessment year, maintenance fees must be paid for all of their mining claims for the assessment year that was previously waived and for the upcoming assessment year.
