EEO Complaint Process
An EEO counselor must be contacted within 45 calendar days of the discriminatory matter alleged, or in the case of a personnel action, within 45 calendar days of the effective date of the action.
The EEO counselor will attempt an informal resolution of the matter within 30 calendar days. The counselor is tasked with conducting a fact-finding of the issues, but is not tasked with making a finding of discrimination or non-discrimination. If a resolution to the complaint cannot be reached within the 30-day period (barring no extension), the EEO counselor must, not later than the 30th day, provide the aggrieved a written notice (Notice of Final Interview) of the right to file a formal complaint of discrimination.
A formal complaint of discrimination may be filed within 15 calendar days of the end of the 30-day counseling period or the Notice of Final Interview, whichever is later It must be submitted in writing, preferably on form DI-1892 (available from the EEO office). The formal complaint must be sent to: EEO Mgr., BLM EEO Alaska State Office, 222 W. 7th Ave., #13, Anchorage AK 99513.
Role of the EEO Counselor
EEO counselors are an integral part of the complaint process and will provide counseling to any employee or applicant for employment with the agency. They are responsible for:
Informing you of your equal employment opportunity rights and their role in supporting your rights
Informing you of the DOI internal complaint process and all steps you may be required to take
Providing instructions on how and where to file a complaint
Providing additional guidance on federally mandated time limits and procedures
Informing you of the DOI CORE-Plus program as an option for resolving your issue(s)
Gathering as many details about the alleged discriminatory act as possible
Informally working to resolve the alleged discriminatory act
Advise individuals in writing of their rights and responsibilities in the EEO process the issue discussed and the actions taken during counseling
Once a formal complaint is filed, submit a written report to the agency's EEO office concerning the issue discussed and the actions taken during counseling.
